End-User License Agreement (EULA) for Towns ‘n’ Fields (Legal)

This End User License Agreement (“Agreement”) is a legal agreement between you (“End User” or “you”) and Eitan Borisov, doing business as Toham Studios (the “Company” or “we”), that governs your use of Towns ‘n’ Fields (the “Game”).
By downloading, installing, accessing, or using the Game, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, access, or use the Game.

License

Subject to the terms of this Agreement, the Company grants you a non-exclusive, non-transferable, revocable, limited license to use the Game for personal entertainment and other non-commercial purposes. You may not use the Game for commercial purposes without prior written consent from the Company, except for non-merchandise content creation (e.g., streaming, video reviews, etc.), which is allowed if it does not misrepresent the Game or violate the Company policies.

Restrictions

You shall not:

1. Decompile, disassemble, translate, reverse engineer, or attempt to extract the source code of the Game, except where expressly permitted by law, or create derivative works based on the Game;
2. Distribute, sell, sublicense, rent, lease, or otherwise transfer the Game or any rights therein;
3. Remove or alter any copyright, trademark, or other proprietary notices from the Game;
4. Use the Game for any unlawful purpose or in violation of any applicable laws or regulations of your state, and/or of the State of Israel, and/or facilitate or promote activities that harm national or international security, including but not limited to terrorism, human trafficking, organized crime, arms proliferation;
5. Collect or harvest personal data from other users without their consent;
6. Run the Game on sensitive or critical systems, including but not limited to: energy infrastructure (e.g., power plants), government or military command systems, aerospace or space systems, medical devices, and artificial intelligence systems designed for national security or ethical-sensitive applications;

Assets

You may freely use the Game’s assets (the “Assets”), including but not limited to images, music, sounds and JSON (including JSON5) files, provided they remain within the Game, are used in modifications, or are shared with the community in connection with the Game or its modifications.

Using the Assets, even if they are used as part of a modification or other permitted uses described above, is strictly prohibited in the following cases:

1. Commercial purposes;
2. Damaging the reputation of the Game, the Company, its developers and/or any person affiliated with the Company;
3. Promoting or facilitating political agendas, parties, candidates, or political ideologies; or promoting conspiracy theories presented as true fact;

Ownership

The Game, including all intellectual property rights therein, is owned by the Company and its licensors and is protected by copyright and other intellectual property laws. This Agreement does not convey to you any ownership interest in the Game.

Indemnification

You agree to indemnify, defend, and hold harmless Toham Studios, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Game in violation of this Agreement or any applicable law.

Termination

This Agreement is effective until terminated. You may terminate this Agreement at any time by deleting the Game and ceasing all use. The Company may terminate this Agreement at any time without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Game and destroy or delete all copies of the Game in your possession or control.

Disclaimer of Warranty

THE GAME IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT GUARANTEE THAT THE GAME WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS OR REVENUES, DEVICE DAMAGE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE COMPANY IS NOT RESPONSIBLE FOR ANY DAMAGES CAUSED BY THIRD-PARTY SOFTWARE, UNAUTHORIZED MODIFICATIONS, OR SECURITY BREACHES AFFECTING THE GAME OR RELATED SERVICES.

Privacy

The Company does not collect, store, or share any personal or gameplay data. The Game operates entirely offline, does not require an account, and does not transmit data to the Company or third parties. The Game does not include tracking, analytics, or any form of remote data collection.

The Game generates logs each time it runs and records certain in-game events. These logs are stored locally on your device and are not automatically collected or uploaded to our website (townsnfields.com). However, if you contact us regarding bugs or malfunctions, we may request these logs to assist with troubleshooting. While providing logs is entirely optional, failure to do so may limit our ability to offer support or address issues in future updates.

Changes

The Company reserves the right to modify this Agreement from time to time, without prior notice. The updated Agreement becomes effective upon publication. Continued use of the Game after the changes take effect constitutes your acceptance of the updated Agreement. The date of the latest revision is indicated at the beginning of this Agreement, under its header. It is your responsibility to review this Agreement periodically.

Severability Clause

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Miscellaneous

This Agreement constitutes the entire agreement between you and the Company regarding the subject hereof and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings between you and the Company. This Agreement shall be governed by and construed in accordance with the laws of Israel, and any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Israel.
